Experience Highlights

  • (S.D. Tex.) — Obtained dismissal of $33 million tort claim on forum non conveniens grounds on behalf of global engineering and construction company

  • (Arbitration) — Represented oil & gas equipment and operations company in arbitration proceedings related to purchase and sale agreement

  • Represented a global engineering and construction company in all matters—an SEC investigation, securities fraud litigation, and shareholder derivative litigation—related to a financial restatement arising out of accounting for long-term construction contracts

  • (Arbitration) — Acted on an ICC arbitration in connection with the design and construction of a major maritime project in Central America

  • (D. Colo.) — Represented an energy company in a dispute regarding whether a Market Disruption Event had occurred under the terms of their long term NAESB contracts for natural gas, impacting price to be paid; the jury unanimously found that the plaintiff breached the contracts and awarded a $60 million (net) verdict in favor of the client

  • (Colo. Dist. – Denver Cnty. and Arbitration) — Secured an arbitration award on behalf of an energy company rejecting the claimants’ attempt to substitute an alternate index price into long term NAESB gas purchase agreements, which was affirmed by a state district court in Denver, Colorado

  • (Colo. Dist. – Denver Cnty.) — Assisted in obtaining a nearly $96 million (net) jury verdict on behalf of an energy company against two purchasers of natural gas for breaching long-term contracts to purchase gas; the jury also rejected the purchasers’ force majeure defense and breach of contract claims against our client, the energy company, for approximately $35 million

  • (Arbitration) — Represented the preeminent cancer center in the country in an arbitration brought against it by its district energy provider; the case involved claims for breach of contract and counterclaims involving board governance and rate-making issues; after a week-long arbitration, the panel denied our opponent’s breach of contract claims and granted judgment in our client’s favor, resulting in approximately US$30 million of savings for the cancer center over the life of the contract
