Anita’s principal areas of practice are federal and state energy regulation, energy transactions, and regulatory litigation. She has represented clients in the full range of proceedings before the Federal Energy Regulatory Commission, as well as in matters before federal appellate courts, the Department of Energy, the Department of State, and the National Transportation Safety Board.
Anita has represented interstate natural gas pipelines, storage companies, shippers on natural gas pipelines, LNG importers, prospective LNG exporters, producers, marketers, local distribution companies, intrastate pipelines, Hinshaws, and other participants in the energy industry.
Anita has advised clients on the prosecution of certificate applications and the negotiation of related precedent agreements, and rate case and restructuring matters; compliance with federal and state regulations; prosecution of related appellate litigation; and development of proposed legislation. She has assisted clients on contracts involving the transportation, storage, and sales of natural gas, and the acquisition of U.S. energy assets.

Represented a natural gas pipeline in a FERC certificate proceeding to construct a greenfield expansion into Manhattan
Represented a natural gas pipeline in a FERC certificate proceeding for the expansion of an existing system to supply capacity constrained New England Markets
Representing a natural gas storage facility on all certificate, tariff, and compliance matters, as well as with other startup matters, such as the negotiation and execution of storage service agreements and gas purchase agreements for obtaining pad gas
Represented a natural gas pipeline in connection with obtaining approvals from FERC of nonconforming service agreements for a number of natural gas pipeline companies
Represented pipeline company operating in Oregon, California, and Nevada in all significant regulatory proceedings before the FERC, including rate, certificate, and compliance matters, and all related project work, including the first two major expansions of its system
Assisted a pipeline company, extending from South Texas and offshore Gulf of Mexico to the Mid-Atlantic and the Northeast, in rate, certificate, compliance, and audit matters before the FERC
Assisted an interstate natural gas pipeline, extending from Tennessee to Virginia, in all regulatory matters before the FERC
Prosecuted certificate applications involving expansions of affiliated pipelines located in the Northeast and Mid-Atlantic regions, including pipeline looping, compressor additions, major market laterals, and mainline expansions and extensions
Represented a project sponsor in connection with the negotiation of precedent agreements and the preparation of pre-filing documents for a pipeline expansion and extension project with project capacity of 800,000 Dth/d through New Jersey and New York
Assisted a project sponsor in the prosecution of a certificate application for an 800-mile, cross-border greenfield pipeline
Represented a pipeline company in a $289 million pipeline expansion project in Tennessee, North Carolina, and Virginia
Represented a storage facility in Virginia in its first rate case proceeding following project development
Represented multiple pipeline companies in gas quality and interchangeability proceedings to address the introduction of local natural gas production and LNG supplies, as well as in the negotiation of related settlements
Represented a natural gas storage project under development in Pennsylvania and Mississippi in regulatory proceedings before the FERC, as well as in the D.C. Circuit mediation
Advised a project sponsor in the preparation and prosecution of a FERC certificate application for the construction and operation of a new salt dome storage project in Louisiana
Represented a project sponsor in the construction and operation of the first independent storage reservoir project in the Rockies, including with respect to tariff implementation and certificate amendment matters
Advised an owner and operator of underground salt dome storage caverns, and related pipeline facilities, in Louisiana and Texas, in regulatory matters before the FERC
Represented a project sponsor of the first open access offshore natural gas storage facility, with 50 Bcf of working gas capacity in Alabama state waters, in prosecution of a certificate application before FERC for development, construction, and operation of offshore and related onshore facilities
Represented one of the first pipelines to restructure its services pursuant to the FERC’s Order No. 636 in proceedings concerning service restructuring, rate realignment, and transition cost recovery
Represented a local distribution company and its affiliates in proceedings before the NTSB and in the defense of law suits relating to pipeline safety matters in state and federal courts
Advised petitioners and intervenors in numerous appellate proceedings, including review of FERC orders in both company-specific proceedings and industry-wide rulemakings
Advised pipeline companies regarding the acquisition of DOE import authorizations for the import and export of natural gas
Advised in the preparation of applications for market-based rate authorization and related waivers for various storage companies
Advised shippers in various compliance matters and waiver proceedings relating to FERC’s capacity release regulations, the shipper-must-have-title policy, and buy-sell policy, as well as asset management arrangements
Advised interstate pipelines, storage providers, and marketing companies with respect to complaint and enforcement matters at the FERC, including responding to FERC investigations
Advised multiple FERC-jurisdictional pipelines on compliance with energy affiliate standards of conduct regulations, including the establishment of organizational structures and operating practices in compliance with FERC policies and regulations
Advised on regulatory and contract issues affecting various acquisitions of FERC-jurisdictional facilities by U.S. and foreign investors, and conducted regulatory assessment and due diligence review in connection with the acquisition of major interstate pipelines
Advised lenders regarding general regulatory issues, as well as due diligence, contract, and regulatory issues, associated with financings, acquisitions, and sales of natural gas pipelines and related facilities
Represented pipeline companies operating in the Northeast in significant regulatory matters before the FERC, including certificate, Section 4 rate increase, restructuring, audit, and compliance matters, and assisted in related agency proceedings
Represented an LNG producer on all regulatory proceedings before the FERC in connection with the recommissioning of an LNG import terminal
Represented lead intervenors in contested proceedings to establish rates for LNG import terminalling services
Represented an importer of LNG before the FERC in certificate, rate case, and tariff proceedings at various LNG import terminals
Represented a local distribution company in contested proceedings before the Department of Energy involving LNG exports
Advised on regulatory and contract issues, and conducted regulatory assessment and due diligence review, in connection with the acquisition of LNG import terminal assets
Advised LNG storage facility operating in the Northeast regarding significant regulatory matters before the FERC, including rate, certificate, restructuring, and standardization matters
