In a detailed Q&A with the Texas Lawbook, Vinson & Elkins litigation Partners Marisa Secco Giles and Nick Shum offered their impressions about the Texas Business Court as the court approaches its two-year anniversary.
Giles noted that the Court has largely met expectations as Texas’ answer to the Delaware Court of Chancery. “The Court is doing incredibly well. Filings have gone up significantly, and we expect that to continue,” she said.
Shum echoed that assessment, pointing to the Court’s efficiency as a standout benefit for clients. “You can have a firm bench trial date within 12 months of a suit being filed and a jury trial within 18 months,” he said, adding that judges consistently come to hearings prepared and having read all the briefings beforehand.
Both Partners identified dedicated courtroom space and longer, staggered judicial terms as the most important priorities for the Court’s continued growth and credibility as a premier forum for high-value commercial disputes
