Counsel Stephen Josey will speak on a panel titled “Learning from Learning Resources: Update on Tariff Enforcement and Refunds” on Friday, June 26 at 3:50 p.m. ET. In its landmark 6–3 decision in Learning Resources, Inc. v. Trump, the Supreme Court held that the International Emergency Economic Powers Act (IEEPA) does not grant the President authority to impose tariffs. This ruling created an unprecedented administrative scramble for refunds of billions of dollars paid pursuant to now-terminated Executive Orders. The panelists will examine the Court’s analysis and its implications for the legal framework and policy considerations governing customs duties.
