Partner Joyce Adetutu has been quoted in multiple media outlets analyzing the U.S. Supreme Court’s ruling on tariffs imposed under the International Emergency Economic Powers Act (IEEPA) and the implications for importers seeking potential refunds.
She was featured in the Associated Press discussing the scope and logistical hurdles of issuing refunds. She cautioned that the process will not be smooth: “It’s going to be a bumpy ride for a while.” She added, “The amount of money is substantial. The courts are going to have a hard time. Importers are going to have a hard time.”
She further joined the Bloomberg Intelligence Podcast to discuss the lawsuit challenging the tariffs, how the Court may rule, refund procedures courts may put in place if the tariffs are struck down, how courts may limit refunds, and what parties should do to protect their rights.
Following the Supreme Court’s decision, Adetutu was quoted by CNBC on the practical challenges of implementing any refund process through the U.S. Court of International Trade.
“I don’t think that is going to be the scenario here,” said Adetutu, referring to the possibility of broad-scale refunds issued immediately. “I think what’s more likely is that the CIT and the government, Customs, are going to work together to try to allow those who have preserved their claim for a refund to seek that refund … and those who don’t protest will forfeit any refund.”
She was also quoted in The Economic Times, examining the potential administrative burden of refund claims. As reported, she noted that untangling complex customs records “is going to take quite a bit of time” and will be “an administrative burden.”
Adetutu works closely with clients on export controls, economic sanctions, tariffs, and national security reviews, advising them on complex cross-border trade and compliance matters amid evolving U.S. trade policy.
