Joyce Adetutu Discusses Tariff Refunds and Risks on Bloomberg Intelligence Podcast

Vinson & Elkins Partner Joyce Adetutu joined Bloomberg Intelligence on the Votes and Verdicts podcast to discuss the status of refunds tied to IEEPA tariffs the Supreme Court found unlawful in February.

Some importers, Adetutu explained, have explored the idea of credits on future entries instead of tariff refunds. “So, for all those IEEPA tariffs that were paid for which they were entitled to a refund, [importers] want to basically say if we import things in the future that are subject to a duty, we want you to credit it against what you owed us on the refund,” she said. “Now that there is a procedure for refunds, I don’t think . . . credits will actually happen, but it’s a really interesting concept.”
