Michael Jay is a first-chair trial lawyer with over twenty years of experience in patent and trade secrets litigation. He has represented a broad range of clients in intellectual property matters, including in jury and bench trials and appellate proceedings, in cases involving such diverse technologies as telecommunication and wireless communication protocols, smartphones, semiconductors, integrated circuits, computer software, Ethernet controllers, medical devices, biological products and pharmaceuticals. Experience

  • Mobile Device Patent Litigation (E.D. Tex., PTAB & Federal Circuit) – Represented a global smartphone manufacturer in a series of patent disputes involving mobile devices, wireless communications, multimedia functionality, and software technologies. Following an adverse jury verdict in a seven-patent case in the Eastern District of Texas, obtained judgment as a matter of law overturning the verdict and secured invalidation of asserted claims in parallel inter partes review proceedings.

  • Image Capture and Mobile Device Technologies Investigation (ITC) – Represented a global smartphone manufacturer in a multi-patent investigation involving image capture, high dynamic range imaging, display technologies, wireless communications, and related software functionality. The investigation proceeded through evidentiary hearing before the International Trade Commission in 2026.

  • Standards-Essential Patent Litigation (D. Del.) – Represented a leading consumer electronics company in a patent jury trial in the District of Delaware involving patents declared essential to the LTE standard and related FRAND issues. Obtained a complete defense verdict of noninfringement after successfully narrowing the case from six asserted patents to two patents before trial.

  • Video Streaming Patent Litigation (C.D. Cal., PTAB & Federal Circuit) – Represented leading streaming media companies in patent litigation involving video streaming technologies. Obtained a stay pending Patent Office review and secured invalidation of all asserted patent claims in inter partes review proceedings, which the Federal Circuit subsequently affirmed.

  • Image Capture Technology Patent Litigation (N.D. III. & W.D. Tex.) – Represented a global smartphone manufacturer in patent litigation involving image capture technologies. Invalidated all asserted claims of three asserted patents through Patent Office proceedings and summary judgment of noninfringement on the remaining asserted patent.

  • Remote Access Software Patent Litigation (D. Del.) – Trial counsel to a multinational software company in a patent jury trial involving remote access and connectivity technologies. At trial in the District of Delaware obtained a damages award that was a small fraction of the amount sought by the plaintiff.

  • Scanning and Automation Technology Litigation (ITC, W.D. Tex. & International Proceedings) – Represented a global technology company in a worldwide patent dispute involving barcode scanning, mobile computing, RFID, imaging, and warehouse automation technologies. The dispute included proceedings before the ITC, U.S. district courts, and courts in Europe and Asia, and concluded with a global resolution under which the client received $360 million.

  • File Management and Networking Patent Litigation (N.D. Cal.) – Represented a leading consumer electronics company in patent litigation involving seven patents directed to file management and networking technologies. Obtained invalidation of all asserted patent claims under 35 U.S.C. § 101.

  • Patent Inventorship and Ownership Litigation (N.D. Cal.) – Represented a medical diagnostics company in litigation involving patent inventorship, ownership, and validity issues relating to bodily fluid analysis technology. Achieved a favorable settlement during trial.

  • Semiconductor Patent Litigation (C.D. Cal.) – Represented a leading semiconductor company in patent litigation involving semiconductor technologies. Obtained a successful trial verdict and permanent injunction against a competitor.

  • Standards-Essential Patent Litigation (ITC & N.D. III.) – Represented a global smartphone manufacturer in litigation involving standards-essential wireless communication patents. Developed defenses that resulted in dismissal of the International Trade Commission investigation and a favorable resolution of the related district court litigation.
