Experience Highlights
(5th Cir.), (S.D. Tex.) – Obtained complete dismissal of conversion, civil conspiracy, and breach of fiduciary duty claims under Rule 12(b)(6); affirmed on appeal by the Fifth Circuit
(5th Cir.), (S.D. Tex.) – Obtained dismissal of business disparagement claim under Rule 12(b)(2) and summary judgment dismissal of fraud and DTPA claims; affirmed on appeal by the Fifth Circuit
(Tex. Dist. – Nueces Cnty.) – Represented energy company in several wrongful death and personal injury lawsuits arising out of an explosion caused by a line strike; achieved favorable resolution of those lawsuits
(Tex. Dist.—Harris Cnty.) – Representing energy company in multidistrict litigation (“MDL”) action involving 125 lawsuits that allege property damage caused by the construction of pipelines; successfully transferred the lawsuits into an MDL proceeding over the plaintiffs’ objection
(Tex. App.— Houston [14th Dist.]) – Assisted in obtaining affirmance of $1.37 million sanctions award on remand from the Texas Supreme Court for a case brought in bad faith and for an improper purpose
(AAA Arb.) – Represented steel company in breach of contract action against a former customer; obtained award for all damages sought
