Overview
Michael is a member of the firm’s Complex Commercial Litigation group practicing in both federal and state courts. His wide range of
experience in all stages of litigation includes defending lawyers and law firms in professional liability matters, representing debtors, creditors, equity holders, and special committees in restructurings and distressed situations, and handling matters for energy, finance, and private equity clients, among others.
The following is a list of representative matters in which Michael has assisted.
(Bankr. S.D. Tex.) – Represented law firm in adversary proceeding by liquidating trustee; obtained dismissal of numerous claims at pleadings stage resulting in favorable settlement
Part of team at Vinson & Elkins that advised the Officer Special Committee of Matterhorn Buyer, LLC, in connection with an investigation into potential claims and causes of action held by the debtors in the chapter 11 cases of Hearthside Food Services
(Bankr. N.D. Tex.) – Represented law firm in defense of a legal malpractice claim asserted by a bankruptcy trustee in an adversary proceeding; obtained favorable settlement
(Bankr. Del.) – Obtained favorable outcome for private equity client in contested bankruptcy trial concerning real property leases; examined key witness
Danimer Scientific, Inc., a leading producer of biodegradable and compostable plastic alternatives, in connection with the sale of substantially all of its assets through chapter 11 bankruptcy cases filed in the U.S. Bankruptcy Court for the District of Delaware
(Tex. Dist. – Tarrant Cnty.) – Represented law firm in defense of legal malpractice claim; obtained complete dismissal of case on summary judgment
(Bankr. N.D. Tex) – Successfully defended multiple law firms against motion for sanctions resulting in favorable settlement
(Bankr. S.D. Tex) – Along with members of V&E’s Restructuring and Reorganization team, represented mezzanine lender in international dispute resulting in favorable outcome
(American Arbitration Association) – Represented private equity fund in defense of dispute among limited partners; obtained agreed dismissal of arbitration
(S.D. Tex.) – Dismissal of claims against law firm under Rule 12(b)(6) in suit by litigation trustee
(Bankr. S.D. Tex.) – Along with members of V&E’s Restructuring and Reorganization team, represented private equity firm as equity owners of power generation company; plan confirmed
(Tex. Dist. – Travis Cnty.) – Represented law firm in professional-liability case arising from FTC investigation
(Tex. Dist. – Tarrant Cnty.) – Represented beverage company in loan dispute
(Bankr. N.D. Tex.) – Represented law firm in avoidance action by liquidating trustee in an adversary proceeding
