Garrett is a member of Vinson & Elkins’ Appellate section. His practice focuses on appeals and original proceedings in state and federal appellate courts. Prior to joining V&E, Garrett served as a judicial clerk for The Honorable Andrew L. Brasher of the U.S. Court of Appeals for the Eleventh Circuit.
Experience Highlights
(1st Cir.) – Secured a unanimous decision requiring a group of Puerto Rico-based mutual funds to seat new directors after contested shareholder elections and affirming dismissal of the funds’ claims under Securities Exchange Act
(11th Cir.) – Co-drafted amicus brief on behalf of religious freedom organizations successfully supporting a minister that was barred from a county jail’s volunteer ministry program because of his religious expression; the Eleventh Circuit found in favor of the minister, reversed the district court’s summary judgment for the jail officials, holding that they violated the minister’s clearly established First Amendment rights
(Colo. App.) – Obtained affirmance of one of the largest Colorado state court judgments on record ($215 million) on behalf of an energy company in a case in which the lower court found the defendant fraudulently induced our client into signing an agreement for the design and construction of a water treatment facility, and that the defendant breached that agreement
(La.); (La. App. – 4th Cir.) – Successfully defended a $43 million judgment following a jury verdict for a chemical manufacturer in its contract dispute with its industrial gas supplier
(5th Cir.) – Obtained unanimous affirmance of a $14 million fraud judgment for an energy company against its former employee who engaged in a kickback scheme with contractors
(Tex.) – Represented a commercial landlord in petition for review seeking to obtain $4.8 million in holdover rent from a tenant
(U.S.) – Represented independent journalists as amici curiae supporting a reporter who brought First Amendment claims after being arrested for asking questions to a police officer; Supreme Court issued summary vacatur in reporter’s favor
