Court of Appeals Hears Oral Argument Regarding the Proposed Clean Power Plan

Last week, the U.S. Court of Appeals for the District of Columbia Circuit (“D.C. Circuit”) heard oral argument in two related challenges to the Environmental Protection Agency’s (“EPA”) proposed greenhouse gas (“GHG”) emission standards for existing electric utility generating units: In re: Murray Energy Corporation (14-1112) and State of West Virginia, et al. v. EPA (No. 14-1146).

National Governors Association Encourages States to Develop Clean Power Plan Strategies

Last month, the National Governors Association (“NGA”) announced that officials from four states—Michigan, Missouri, Pennsylvania, and Utah—will participate in a “policy academy” designed to help states identify strategies for meeting the requirements of proposed federal regulations to reduce greenhouse gas (“GHG”) emissions from existing power plants (the “Clean Power Plan”).

New Economic Analysis of EPA’s Clean Power Plan Suggests Regional Plans and Renewables May Ease Overall Burdens

PJM Interconnection (“PJM”), the nation’s largest grid operator, recently analyzed the economic impacts of the U.S. Environmental Protection Agency’s (“EPA”) Clean Power Plan on electric power generation. The analysis indicates that regional compliance plans could have lower compliance costs than state-specific plans, and that the use of renewables may slow the pace of retirement for fossil-fuel based generating units.

EPA’s Clean Power Plan Receives Support from Businesses and Economic Study by Environmental Group

On November 19, 2014, the Natural Resources Defense Council (“NRDC”) released an issue brief, finding that the power sector and its customers could save nearly $2 billion in 2020 and $6.4 billion in 2030 while meeting the EPA’s carbon reduction targets. According to the brief, greater reliance on renewable sources of energy and on using energy more efficiently could result in substantial savings.
