Environmental Appeals Board Ruling: Combined-Cycle Turbines are not BACT for GHG Emissions from Natural Gas-Fired Peaker Plants

On August 2, 2013, the U.S. Environmental Protection Agency’s (EPA) Environmental Appeals Board (EAB) upheld EPA Region 9’s best available control technology (BACT) determination for CO2 emissions from the proposed Pio Pico natural gas-fired 300 megawatt (MW) peaker plant, located in Otay Mesa, California.

Texas v. EPA: The Next Round in the SIP Tug-of-War

On July 26, 2013, the D.C. Circuit issued its decision in Texas v. EPA, a challenge to EPA’s authority to promulgate federal implementation plans (“FIPs”) to issue PSD permits for GHGs. Following its prior holding in Coalition for Responsible Regulation v. EPA, the court concluded that Texas and the other petitioners lacked standing to challenge EPA’s rules.
