Scott’s principal area of practice is trademarks. He maintains large and small, domestic and international, trademark portfolios for many clients in various industries. In addition to prosecuting trademark applications, he also handles all forms of trademark-related disputes before the USPTO, in the courts, and before arbitration panels. Scott counsels clients in all areas of intellectual property, including transactional matters involving the transfer of intellectual property, the proper use of copyrighted materials (and regarding other copyright-related matters), and general patents.

Prior to becoming an attorney, Scott worked for nearly a decade as an engineer for a major chemical manufacturer.

Experience Highlights

  • (W.D. Tex.) – Obtained a permanent injunction on behalf of a Texas brewing company in a trademark infringement lawsuit against a California-based company

  • (N.D. Tex.) — Represented a sunscreen and skin care products company in a claim for declaratory relief regarding alleged trade dress infringement; successfully defended a motion for temporary injunction followed by a prompt favorable settlement

  • Counsel a sunscreen and skin care products company specializing in sunscreen regarding protection and registration of domestic and international trademark rights

  • Counsel Texas’ first and oldest legal distillery company, producer of Tito’s Handmade Vodka, regarding protection and registration of domestic and international trademark rights

  • (N.D. Tex.) — Represented a wireless communications provider with its own wireless network in a trademark dilution, trademark infringement, and DMCA exemption case; prevailed in rulings on motion for summary judgment that led to favorable settlement

  • (S.D. Tex.); (TTAB) — Successfully handled a trademark case to enforce our client’s rights in a mark for use in connection with offshore oil equipment and services; after suit was filed, the other side quickly agreed to our client’s demands regarding ownership and use of the mark; we obtained injunction as part of the settlement, and successfully petitioned the Trademark Office to reinstate our client’s trademark registration

  • (S.D. Tex.) — Represented a specialty foods manufacturer in a trademark opposition case and dilution case; prevailed in the opposition proceeding and obtained the trademark registration

  • Counsel a Texas Hill Country brewing company regarding protection and registration of domestic trademark rights

  • (C.D. Cal.) — Represented defendant, a biotechnology company specializing in the production of algae in a false designation and trademark infringement case; negotiated a prompt and favorable settlement

  • Counsel a leading international partnership of independent, fiduciary wealth management firms regarding protection and registration of domestic trademark rights

  • Counsel an asset management company regarding protection and registration of domestic and international trademark rights 

  • Counsel a Texas comic book company regarding protection and registration of domestic trademark rights

  • Counsel a major nutritional and supplement food company regarding protection and registration of domestic and international trademark rights
