Melissa Montgomery James

Melissa is a member of the firm’s Complex Commercial Litigation group.

Her practice focuses on litigation in both state and federal court, including professional liability defense, energy litigation, landlord/tenant disputes, securities litigation, representing companies under investigation by the United States Securities & Exchange Commission, and representing plaintiffs and defendants in other high-stakes litigation.The following is a list of representative matters in which Melissa has assisted.

Oil & Gas Litigation

  • (Tex. Dist. – Harris Cnty.) — Representing an oil and gas producer against another oil company in a reversionary dispute in state court implicating a number of issues concerning properties in Louisiana (lead associate)

  • (Tex. Dist. – Reeves Cnty.) — Represented an oil and gas exploration and production company in successfully resolving dispute over acquisition of oil and gas properties within area of mutual interest in Permian Basin (lead associate)

  • (Dallas Court of Appeals; Tex. Dist. – Dallas Cnty.) — Obtained dismissal of international law firm in dispute over use of $65 million tax deduction based on successful appeal in which the court found no personal jurisdiction over the law firm (lead associate)

  • Helped a national law firm successfully resolve a $46.5 million claim prior to suit being filed (lead associate)

  • (Tex. Dist. – Dallas Cnty.) — Represented national law firm against a professional liability suit alleging malpractice based on real property transaction (lead associate)

  • (Tex. Dist. − Dallas Cnty.) — As trial counsel, obtained a $6.6 million (net) summary judgment in favor of a commercial landlord on a breach-of-lease matter (lead associate)

  • (Tex. Dist. – Harris Cnty.) — Represented tenant in a breach of lease and anticipatory breach of lease case in which tenant sought to enforce termination option (lead attorney)

  • (N.D. Tex.) — Obtained a dismissal of all claims, including invasion of privacy and copyright infringement in Northern District of Texas (lead associate)

  • Represented Big Four accounting firm in connection with its audits of an aerostructures manufacturer’s financial statements and cost of completion accounting for long-term manufacturing contracts and forward loss provisions, and the SEC’s investigation of potential fraud in those financial statements; matter ended with no charges filed (lead associate)

  • (E.D. Tex) — Obtained TRO and return of children under the Hague Convention for a pro bono matter (lead associate)
