Marc A. Fuller

Marc’s practice focuses on media, Internet, and privacy law.  He represents media and nonmedia companies in defamation, invasion of privacy, right of publicity, copyright, and commercial speech cases.

Marc has extensive experience litigating individual and class action cases involving claims under consumer protection and privacy laws, as well as helping companies mitigate their risks in these areas.  He also regularly advises companies on social media, marketing, and open records issues.

Experience Highlights

  • (NY App. Div.) – Obtained affirmance of dismissal of a defamation and tortious interference suit filed against publisher of leading national newspaper

  • (5th Cir.); (E.D. Tex.) – Obtained affirmance of dismissal of RICO, conspiracy, tortious interference, and defamation claims against local newspaper and its employees and owner

  • (Tex.) – Obtained dismissal, under the Texas anti-SLAPP statute, of defamation claims against leading newspaper arising out of a series of investigative articles on alleged healthcare fraud

  • (Wash. App.) – Representing major insurer in defending class action claims brought under various consumer-protection laws

  • (Tex.) – Represented national broadcaster in defending defamation claim brought by neurosurgeon based on investigative news report

  • (Tex. App.) – Obtained appellate victory for multinational ecommerce company against various multi-level marketing companies regarding efforts to unmask thousands of anonymous online sellers

  • (Tex. App.) – Secured dismissal of libel claims by prominent anti-vaccine activist against U.K.-based medical journal and investigative reporter

  • (Tex. Dist.) – Secured dismissal of various claims against Internet service provider by individual allegedly assaulted by someone she met online

  • (U.S. and Tex.) – Authored amicus briefs on behalf of major media organizations, public interest groups, trade associations, and law professors in cases presenting important defamation, privacy, Internet, and First Amendment issues
