Kathleen Bone Spangler

Kathleen’s practice focuses on complex commercial litigation and antitrust. She has represented clients in disputes in state and federal trial and appellate courts, as well as before private arbitration panels.

Her experience covers a range of commercial issues and claims, including breach of contract, fraud, tortious interference, conspiracy, price-fixing and other antitrust issues, securities, and construction claims. She has also been involved in representing clients in commercial class actions, shareholder class actions, and derivative claims, and has represented clients from a variety of industries, including chemical, energy, and insurance. Kathleen has served as a member of the firm’s Electronic Discovery Task Force.

Experience Highlights

  • Assisted in the defense of a chemical manufacturing company in several class action price-fixing lawsuits

  • (Del. Ch.) — Successful prosecution of claims at trial that a major specialty chemical company had not suffered a material adverse effect that would have given rise to the termination of a merger

  • (N.D. Tex.) — Defended a major energy company against securities fraud claims brought by a liquidating trustee relating to investments in mineral interests in the Woodford Shale play in Oklahoma

  • (Tex. Dist. – Harris Cnty.) — Successfully defeated an attempt by limited partners to enjoin a partnership from consummating certain sales of partnership assets

  • (D. Md.) — Represented a major specialty chemical company in a class action case brought by direct purchasers of titanium dioxide

  • (D. Kan.) — Represented a major specialty chemical company in a class action case brought by direct purchasers of polyurethane products

  • (16th Cir. Ct., Jackson Cnty., MO) — Obtained dismissal of an antitrust and RICO lawsuit against a health care group purchasing organization and members of its board of directors (lead)

  • (E.D. Tex.) — Defended a health care client against antitrust claims brought by a medical products supplier

  • (Tex. Dist. – Harris Cnty.) — Represented an insurance brokerage firm against negligence claims brought by the insured in a third-party action against the insurance underwriters

  • (W.D. Tex.) — Defended a telecommunications company against alleged violations of the Employment Retirement Security Act

  • (W.D. Tex.) — Assisted in the successful defense of an insurance company in a securities fraud action

  • (Tex. Dist. – Harris Cnty.) — Represented an energy company in asserting claims related to its purchase of certain midstream assets
