Charles D. Tetrault

Charles is a partner in the firm’s Complex Commercial Litigation practice group. Since joining the firm in 1976, he has handled business and regulatory litigation in state and federal courts, with an emphasis on energy-related matters, and has handled cases before many federal agencies, including the Department of the Interior.

He has extensive experience defending False Claims Act (including qui tam) cases and representing energy companies, defense contractors, and health providers in district courts and before the Department of Justice. He also represents companies and individuals in civil and criminal investigations in the energy, securities, and defense-procurement industries. Recently, Charles has represented individual attorneys in suspension, debarment, and sanctions proceedings before numerous federal agencies.

Experience Highlights

  • Won post-verdict dismissal of a qui tam case brought by a federal auditor alleging underpayment of oil royalties

  • Represents numerous pipeline companies in False Claims Act cases consolidated in a multidistrict proceeding in Wyoming

  • Represents a major oil company in a False Claims Act case involving natural gas in the Eastern District of Texas

  • Obtained dismissal of a RICO case alleging retaliation against a “whistleblower” for bringing a False Claims Act case

  • Defended numerous energy companies in False Claims Act or qui tam cases and government investigations

  • Represents energy and health care providers in qui tam actions in district courts

  • Represented a major oil company in a federal royalty enforcement action concerning sales to affiliates; 332 F.3d 672 (D.C. Cir. 2003)

  • Obtained a temporary restraining order preventing the implementation of a regulatory program by the Federal Energy Regulatory Commission; 345 F.3d 910 (D.C. Cir. 2003)

  • Represents numerous energy companies in two class actions filed in Kansas

  • Defended a major energy company in a lengthy hearing in an enforcement proceeding brought by a federal agency

  • Represented a Fortune 100 company in an ERISA class action pending in the District of Columbia

  • Represented a major health care company in a preliminary injunction trial

  • Defended a major aircraft manufacturer in a federal antitrust group boycott case in Nevada

  • Defended a private equity firm and its individual managing directors in a tortious interference with contract case in federal court in Alaska

  • Represented a major financial institution in numerous lender liability cases

  • Defended a law firm in federal court against a federal agency’s attempt to obtain privileged documents from the law firm

  • Represented lawyers in proceedings before the Department of State, the Government Accountability Office, and the International Trade Commission
