Brock Skelley

Brock is a trial lawyer who represents clients in complex disputes in state and federal courts, and in arbitration. His practice focuses on energy litigation matters, including royalty underpayment class actions, breach of contract cases, and a variety of other disputes in the upstream and midstream sectors. Brock is a member of the firm’s Shale and Hydraulic Fracturing Task Force.

Experience Highlights

  • (Tex. Dist) — Representing oil and gas producer in lawsuit where plaintiffs seeks termination of multiple leases

  • (Tex. Dist) — Representing oil and gas producer in Multi- District Litigation in South Texas involving multiple lawsuits where plaintiffs have asserted claims for  failure to develop, failure to protect against drainage, and underpayment of royalties

  • (Tex Dist.) —  Represented major oil and gas producer in lawsuit where plaintiffs sought approximately $30 million dollars in damages for claims related to development and drainage; the matter was resolved with a favorable settlement prior to trial

  • Represented independent oil and gas producer in investigation by the Office of Inspector General for the Department of Interior related to alleged royalty underpayments alleged and potential violations of the False Claims Act

  • (W.D. Okla) — Represented independent oil and gas company in lawsuit seeking immediate removal of an operator under a joint operating agreement; obtained a favorable settlement whereby the client assumed operations of multiple properties

  • (S.D. Tex.) —  Part of team that successfully represented producer of Akaushi Beef against claims of conspiracy to restrain trade and monopolization in the market for premium beef in the United States; after a seven day trial, the jury found in favor of the client, awarding both actual and exemplary damages 

  • (Tex Dist) — Obtained summary judgment on claims of fraud asserted against an independent oil and gas producer related to the purchase of producing properties in Oklahoma

  • Representing oil and gas production company in multiple royalty lawsuits in federal court in Pennsylvania

  • Represented oil and gas production company in putative class action lawsuit alleging underpaid royalties; obtained order denying class certification 

  • Represented oil and gas producer in appeals of ONRR Orders to Report and Pay additional royalties on Wyoming coalbed methane production and negotiated favorable settlement
