Jordan W. Leu Counsel, Commercial & Business Litigation

Jordan is a business litigator whose practice focuses on professional liability, bankruptcy litigation, and the representation of banks and bank executives in civil, administrative, and regulatory disputes. He is experienced in all stages of a case, including discovery, dispositive motions, and both jury and bench trials.

Jordan frequently works on cases involving contested valuations and sophisticated damage models, and he has particular experience with legal malpractice claims, lender liability claims, contractual disputes, business torts, fiduciary duty claims, and cases brought by bankruptcy trustees.  Jordan also defends bankers in investigations and administrative proceedings by the Office of the Comptroller of the Currency (OCC) and Federal Deposit Insurance Corporation (FDIC).

Experience Highlights

  • (Bankr. S.D. Tex.) — Represented energy company during contested bankruptcy; reorganization plan was confirmed, eliminating approximately $3.5 billion in debt (lead litigation associate)
  • (E.D. Tex.) — Defended national bank against 31 lender liability counterclaims; 30 counterclaims were dismissed on summary judgment, and the bank prevailed on the remaining counterclaim at trial  (lead associate)
  • (5th Cir.); (N.D. Tex.) — Obtained dismissal with prejudice, affirmed by Fifth Circuit United States Court of Appeals, of all claims brought against court-appointed receiver and receiver’s law firm (lead associate)
  • (Bankr. N.D. Tex.) — Defended national law firm against a professional liability suit by bankruptcy trustee alleging malpractice, breach of fiduciary duty, and aiding and abetting, resulting in a partial summary judgment (lead associate)
  • (Office of Financial Institution Adjudication) — Defended current and former bank directors in a variety of matters involving allegations of unsafe or unsound practices, gross negligence, breach of fiduciary duty, false entry, and other violations of law and regulation (lead associate)
  • (Bankr. D. Nev.) — Defended a law firm against professional liability, fraudulent transfer, and preferential transfer claims asserted in Bankruptcy Court (lead associate)
  • (Bankr. D.S.C.) — Defended a retailer against bankruptcy trustee’s fraudulent transfer and preferential transfer claims of over $300 million (lead litigation associate)
  • (Office of the Comptroller of the Currency) — Defended former President and CEO of a south Texas bank in an OCC regulatory investigation; after responding to numerous subpoenas and the client’s deposition, the OCC decided not to assess a civil money penalty (lead associate)
  • (Tex. Dist. − Hidalgo Cnty.) — Represented former directors and officers of a South Texas bank in litigation brought by bank shareholders based on private placement memorandum (lead associate)
  • (N.D. Tex) — Represented a lender in simultaneously pending Bankruptcy Court and District Court cases involving lender liability and fraudulent transfer claims
  • (Tex. Dist. − Dallas Cnty.) — Represented a large hospital in a shareholder oppression and breach of contract suit
