On December 29, 2020, Vinson & Elkins secured a complete dismissal of claims alleged against client Choctaw Construction Services, LLC in the First Court of Appeals in Houston. The case was one of the first successful dismissals under the recently amended Texas Citizens Participation Act.
On December 22, 2019 the U.S. Fifth Circuit affirmed an $11.6 million judgment for Vinson & Elkins client Captain Jay Rivera. Captain Rivera, a harbor pilot, was badly injured when boarding a vessel owned by Kirby Offshore Marine, LLC (Kirby). District Court Judge George Hanks found Kirby liable under both theories offered by Captain Rivera and awarded damages for Captain Rivera’s lost future earnings as a harbor pilot.
On October 4, 2020, Judge Michael Truncale of the Eastern District of Texas issued a 33-page opinion denying a preliminary injunction that would have prevented V&E’s client, Jefferson Energy Companies, from completing the last stages of construction on its 14-mile pipeline that will connect the largest refinery in North America to Jefferson’s crude oil and refined products logistics terminal at the Port of Beaumont, Texas.
