Many environmental suits have provisions that allow citizens and environmental groups to sue for violations. Even if the Trump administration is less aggressive in environmental enforcement, companies face a continued risk from these suits.
This presentation will provide an overview of the citizen suit provisions in various environmental statutes, highlight some recent trends, describe the range of usual outcomes for cases brought under them, and strategies for responding to citizen suit risk, from the prevention of their filing, to their disposition by motion, and to trial, if necessary.
