Vinson & Elkins Obtains Victory in Texas Eastland Court of Appeals on Texas Citizens Participation Act Issue

On August 19, 2021, a team of Vinson & Elkins litigators obtained a victory in the Texas Eastland Court of Appeals for a significant oil and gas taxpayer in Scurry County, Texas.
The opinion, available here, revives the client’s motion to dismiss an ongoing tax dispute by finding that a recent amendment to the Texas Citizen’s Participation Act exempting claims based on common law fraud does not apply to statutory claims.
The Vinson & Elkins team included Mike Heidler, Chris Popov, James Leader and Leslie Mason.
The firm previously secured a victory for the client in a related case before the Texas Supreme Court in April 2021.
