Texas Supreme Court Rules for Anadarko in Multimillion Dollar Deepwater Horizon Insurance Dispute

The Texas Supreme Court has ruled in favor of Vinson & Elkins client Anadarko Petroleum Corp., reviving the company’s claim against Lloyd’s of London (“Underwriters”) for its multimillion dollar defense costs arising out of the 2010 Deepwater Horizon incident in the Gulf of Mexico.

On January 25, 2019, reversing the Ninth District Court of Appeals in Beaumont, the high court ruled that Anadarko may recover under an insurance policy issued by Underwriters costs the company incurred to defend claims resulting from the accident.

The matter is remanded to the trial court to determine the amount of Anadarko’s defense costs. The V&E appellate team included Marie Yeates and Michael Heidler.
