Private Property Condemnation: Office Warehouse Property Partial Taking
V&E condemnation lawyers in Houston, Texas, represented a partnership that owned an office/warehouse along Interstate 610 in connection with the State’s condemnation of a portion of its parking and driveway areas. The taking ran the entire length of the property.
Significantly, the depth of the taking was such that tractor trailers could no longer back into the dock-high loading areas along the front of the building, destroying the functionality of the building for warehouse purposes. The State’s initial set of experts ignored the impacts of the taking on the functionality of the building. A second set of experts acknowledged the damages after V&E was hired, but underestimated the value of the building. The case proceeded to trial, after which the jury returned a favorable verdict for the property owner. V&E represented the property owner in the appeal of the case, wherein the verdict was upheld.
