Private Property Condemnation: Large Shopping Center Partial Taking

The property was improved with over 330,000 square feet of retail space and two restaurants on pad sites near the frontage road.
The State’s taking took out an entire row of parking along the frontage road, including all of the parking in front of a portion of the end-cap retail space and a significant portion of the parking in front of the restaurants, which had a significant impact on the improvements closest to the frontage road. The State’s initial offer ignored these significant damages. After an extensive discovery phase, the case was settled favorably for the property owner just prior to trial.
