With its “all of the above” approach to reducing greenhouse gases, the Biden administration will undoubtedly increase the tempo of EPA enforcement in the upstream and midstream sectors.

This Energy Series discussion is with Patrick Traylor, former Deputy Assistant Administrator over the EPA’s enforcement office, and Ron Tenpas, former Assistant Attorney General at the Department of Justice, which included leading its environmental enforcement program. Both have significant, senior government environmental enforcement experience and both represent upstream and midstream clients who are today likely targets for EPA enforcement in the new administration.

They talk about the options available to the new administration and what the first six months have revealed. Anyone with upstream or midstream assets should be very focused on the EPA’s priorities in those sectors.
