Experience Highlights

  • (USACE) – Assisted Fortune 100 contractor prepare and submit a damages claim under an Energy Savings Performance Contract (ESPC) to U.S. Army Corps of Engineers (USACE) for project cancellation, resulting in a settlement worth more than 90% of submitted claim amount within months of submission and despite USACE denying similar claims by other contractors and an adverse Armed Services Board of Contract Appeals decision in a related matter

  • (COFC) – Represented Medicare and Medicaid contractors in Contract Disputes Act claim litigation regarding entitlement to costs for the curtailments of defined benefit pension plans under the federal Cost Accounting Standards (CAS)

  • (COFC) – Represented facilities maintenance company in two related bid protests challenging the contract award to a competitor, which resulted in favorable corrective action for the client where the agency agreed to reevaluate the client’s proposals on both procurements

  • (ASBCA) – Represented IT solutions company in challenging its terminations for default for work under a contract performed in Afghanistan that experienced issues with an Afghan subcontractor

  • (GAO) – Represented facilities management company in protesting the award of a contract to a competitor for security system services in federal facilities nationwide, resulting in corrective action where the agency agreed to reevaluate proposals, giving the company another chance at award

  • (GAO) – Represented defense contractor intervening in a bid protest, which resulted in the successful defense of its award of a $300 million contract for operations and management services in support of a federal agency’s Office of the Chief Information Officer

  • (CBCA) — Represented Private Collection Agency in Contract Disputes Act claim litigation for unpaid performance bonuses, which resulted in favorable settlement

  • (GAO) – Represented maritime logistics company in a bid protest challenging the award of a contract for the delivery of liquified natural gas (LNG) to an overseas military station, which resulted in favorable corrective action, with the agency agreeing to reopen negotiations and accept new final proposals from all offerors

  • (GAO; COFC) – Represented various other companies as protester or intervenor in bid protests to assert or address challenges to high-value contract awards by various government agencies

  • Conducted internal investigation for government contractor in response to federal agency subpoenas regarding the procurement and performance of various government contracts for energy services at federal facilities

  • Counseled government contractor in creating information management policy to ensure compliance with data-related contractual obligations under various government contracts

  • Assisted in investigation into alleged Procurement Integrity Act violations by former government official, and represented the former official in related suspension proceedings, resulting in significant mitigation of suspension period

  • Regularly assist government contractors in drafting subcontract documents and frameworks that remain compliant with applicable regulatory and contractual obligations when subcontracting work under a prime contract

  • (CFIUS) –Represented U.S. aerospace company in joint notice submission to CFIUS regarding sale of businesses that provide national security-related products and services to a Canadian buyer

  • (CFIUS) – Represented U.S. software solutions company that produced critical technologies in joint declaration submission to CFIUS regarding sale to Swedish buyer

  • (CFIUS) – Represented Canadian energy company that owned critical infrastructure in the United States in declaration submission to CFIUS regarding a merger transaction

  • (DCSA) – Assisted aerospace company in negotiating an updated Foreign Ownership, Control or Influence (FOCI) agreement with the Defense Counterintelligence and Security Agency

  • (CFIUS) – Represent various other companies in notice and declaration filings to receive foreign investment approval for transactions in industries that implicate U.S. national security concerns

  • Regularly assist companies in diligence and transactional support related to CFIUS obligations and other national security concerns
