Jay Rothrock Senior Associate, Environmental & Natural Resources

Jay’s principal area of practice is environmental law, with emphasis on environmental and toxic tort litigation, cost recovery litigation, enforcement defense, and emergency response to refinery, plant, and pipeline accidents. His other practice areas include permitting and transactional environmental issues, environmental criminal defense, and general litigation. Jay is a member of the firm’s Shale and Hydraulic Fracturing Task Force. The following is a list of representative matters in which Jason has assisted.

Experience Highlights

  • Represented a leading private equity group in the acquisition of 300,000-barrel-per-day crude oil refinery in Philadelphia, including in connection with obtaining groundbreaking environmental approvals from federal, state, and local governments
  • Represented the operator of an LNG liquefaction facility in various matters before PHMSA 
  • Drafted pleadings in a CERCLA cost recovery action that resulted in an award of default judgment 
  • Drafted key discovery motions in a CERCLA cost recovery action involving $150 million in alleged liability
  • Defended a client against an NSR initiative against the sulfuric acid industry
  • Assisted in the preparation of expert witness, depositions of adverse witnesses, and preparation of Daubert motions in soil contamination case
  • Assisted a large, interstate pipeline company in negotiating the allocation of responsibility for existing and prospective environmental liabilities in the context of a $110 million merger and acquisition
  • Advising client on litigation and expert witness strategy related to one of the Nation’s largest Superfund sediment sites 
  • Played a leading role in diligence and negotiation of an allocation of responsibility for existing and unknown environmental liabilities in numerous transactions 
  • Assisted in the representation of issuers and underwriters with respect to environmental issues in connection with public offerings in coal, pipeline, maritime, and other industries
  • Assisted in environmental and climate change due diligence on transactional matters for the power and chemical manufacturing industries
