George Robertson Murphy Partner, Condemnation & Eminent Domain

George is a partner in V&E’s Condemnation and Land Use Litigation practice group. His trial practice is principally focused on the representation of private property owners involved in eminent domain lawsuits wherein the state, counties, municipalities, and other government authorities seek to acquire his clients’ property. He has extensive first chair jury trial experience confirmed by his invited membership in the American Board of Trial Advocates (ABOTA), and has represented owners of properties of all types, including retail, commercial, industrial, and residential properties. George has been selected by his peers for inclusion in the publications Best Lawyers in America and by Texas Super Lawyers for his extensive experience in Eminent Domain and Condemnation Law.

George’s practice also includes representation of several common carrier pipelines and utility companies who have the authority to acquire private property.

George is a frequent speaker on legal issues related to eminent domain, including both statutory and regulatory takings.

  • Jury verdict 1,005% above County’s First Offer – Jury trial verdict in a partial takings case for the County’s Hardy Toll Road Extension Project for the owner of a trucking facility in Harris County, Texas in an amount 1,005% above the County’s first offer; it is anticipated that the County will file an appeal (trial counsel, monetary damages)
  • Jury verdict 292% above State’s First Offer – Jury trial verdict in a partial takings case for the Grand Parkway for the owner of retail pad sites in front of a big-box shopping center in Montgomery County, Texas in an amount 292% above the State’s first offer (trial counsel, monetary damages) 
  • Jury verdict resulting in 283% increase in Compensation to Client – Jury trial verdict for the owner of a large grocery company related to the condemnation by the State of a part of its retail development for the construction of the Grand Parkway in Montgomery County, Texas, resulting in a net recovery of $4.6 million on an original offer of $1.2 million (trial counsel, monetary damages) 
  • Combined Jury verdicts 292% above State’s Combined First Offer – Combined jury trial verdicts equivalent to compensation sought at trial in one case involving two commercial reserve parcels (consolidated prior to trial) owned by the same entity that were taken for the Grand Parkway in Harris County, Texas; these cases are currently on appeal (trial counsel, monetary damages) 
  • Jury verdict 367% above State’s Compensation Estimate – Jury trial verdict 40% above compensation sought at trial by owner of commercial reserves taken for the Grand Parkway in Harris County, Texas, and 367% above State’s first offer; this case is currently on appeal (trial counsel, monetary damages)
  • Lead counsel in a jury trial for the developer a large anchored retail development in Montgomery County, Texas, a part of which was condemned by the State for construction of the Grand Parkway toll road
  • Lead counsel in a jury trial for a property owner whose property was condemned for the widening of FM 529 in Harris County, Texas
  • Lead counsel in a jury trial for the acquisition of property needed by an electric utility client for a transmission line project in Wise County, Texas
  • Lead counsel for the acquisition of approximately 180 miles of right-of-way in multiple counties in North Texas needed by a client for CREZ transmission line projects
  • Lead counsel for the acquisition of approximately 300 miles of right-of-way in multiple counties in the panhandle region of Texas needed by client for CREZ transmission line projects
  • Lead counsel for a property owner in a jury trial for condemnation of commercial property on I-45 in Conroe, Texas
  • Co-counsel for a property owner in jury trial for a highway widening case involving property improved with a Class A self-storage facility in Houston, Texas

    • Represented a manufacturer of asbestos-containing products as trial counsel in various counties throughout the State of Texas
    • Represented several major oil companies and a shipyard in asbestos- and silica-related premises liability litigation
    • Represented a major oil products manufacturer in Federal District Court in Galveston, Texas, in a premises liability lawsuit involving catastrophic personal injuries resulting from an industrial plant accident in Cincinnati, Ohio
    • Represented major building products manufacturer in a multiparty case involving property damage and product liability claims in combined construction/personal injury litigation resulting from the failure of a commercial building
    • Represented a municipal utility district in arbitration relating to the construction of an outfall structure, including claims for equitable adjustment, changed conditions, delay, and suspension damages
    • Represented a national pharmacy chain in pharmaceutical malpractice and inadequate security claims involving death, rape, and other serious injuries
    • Served as arbitrator in two AAA arbitration proceedings involving contract disputes and unfair trade practices claims
