Todd E. Landis Partner, Intellectual Property

Todd practices intellectual property litigation in the areas of electronic arts, including computer-related technology, wireless technology and solid state circuit design, chemical arts and oilfield services.

Todd is a nationally recognized trial lawyer with experience handling complex patent litigation cases as well as other types of intellectual property matters. Todd has served as trial counsel in many intellectual property litigation cases, and he has significant trial and Markman hearing experience. He has argued over 30 Markman hearings and has been lead trial counsel on multiple patent cases. He has represented companies as both plaintiff and defendant in patent infringement cases. Todd is known for his ability to translate difficult technological concepts in easily understood concepts for both judges and juries. He also has extensive experience in transactional aspects of intellectual property law, including complex licensing.

Experience Highlights

  • (E.D. Tex.) – Obtained jury verdict of noninfringement for leading smartphone maker in patent litigation involving universal remote control technology
  • (Fed. Cir.); (D. Del.) — Defended several major gaming companies in a patent infringement lawsuit related to peer-to-peer network technologies; obtained summary judgment of non-infringement after successful claim construction proceedings; Federal Circuit affirmed on appeal
  • (E.D. Tex) — Acted as lead technical trial counsel for one of the world’s largest television manufacturers; the case involved the decoding and scaling of television signals from over-the-air broadcasts, including the use of the Viterbi algorithm; after taking over the technical aspects of the trial just two weeks before trial began, obtained a complete jury verdict of noninfringement and invalidity; the verdict was later upheld on appeal to the Federal Circuit
  • (E.D. Tex) — Acted as lead technical trial counsel for a leading social gaming company; the case involved online computer gaming systems and the ability to provide particular information to the game participant during the gaming experience; after taking over the case six weeks before trial, obtained a jury verdict of noninfringement 
  • (N.D. Cal.) — Obtained summary judgment of noninfringement for one of the world’s largest cellular phone providers in a patent infringement case involving switching between WiFi and cellular operations
  • (ITC) — Acted as lead technical trial counsel for the world’s leading PC manufacturer in a case involving noise cancellation technology used with multiple microphone PCs; after deposing the technical expert and obtaining admissions of noninfringement, the case settled on favorable terms one month before trial
  • (D. Or) — Acted as lead technical trial counsel for the world’s leading PC manufacturer in a case involving methods for transferring settings information from one computer to another; obtained summary judgment of invalidity based on § 101 and the Supreme Court’s Alice decision

  • (E.D. Tex.) — Defending one of the world’s largest cellular phone providers in a patent infringement case involving secure authorization technology
  • (E.D. Tex.); (D. Del.) — Defending the world’s leading provider of satellite television in a patent infringement case involving digital rights management and digital video recorder technologies
  • (E.D. Tex.); (W.D. Tex.); (D. Del.); (N.D. Cal.); (C.D. Cal.); (S.D. Cal.); (E.D. Va.) — Representing the world’s largest personal computer company in dozens of cases involving WiFi, WiMax, 3G, 4G and Bluetooth® wireless technologies
  • (E.D. Tex.); (N.D. Cal.) — Defending a major wireless manufacturer and its leading wireless carrier in multiple cases relating to WiFi, 3G and 4G wireless technologies, including with respect to various modulation schemes employed 
  • (E.D. Tex.) — Defended 21 of the world’s largest telecommunications companies (six handset manufacturers and 15 wireless carriers) litigating the invention of smartphone technology; won partial summary judgment of indefiniteness and invalidated all asserted claims in inter partes re-examinations
  • (E.D. Tex.) — Defending a leading cellphone manufacturer in litigation regarding modem technology 
  • (E.D. Tex.); (N.D. Cal.) — Defending a major supplier of laptop computers in cases involving various components of laptop computers 
  • (E.D. Tex.) — Defending a major SDRAM manufacturer in litigation regarding voltage regulation and power-boosting technology 
  • (E.D. Tex.) — Acting as co-lead trial attorney in prosecuting infringement claims on behalf of a major oilfield services company, resulting in the fourth largest patent judgment in 2004
  • (S.D. Tex.) — Defending an international worldwide leader of drill pipe and casing in litigation regarding insulator sleeve technology
  • (W.D. Tenn.) — Defending a major medical device manufacturer against claims of patent infringement, correction of inventorship, trade secret misappropriation, fraud, breach of contract and deceptive trade practices; prosecuted counterclaims for breach of contract, tortious interference and misappropriation of trade secrets
  • (S.D. Tex.) — Defending a major chemical supplier in litigation involving the manufacture of acetic acid
