Zachary J. Howe Associate, Appellate

Zach’s principal area of practice is appellate litigation.  He has briefed and argued civil and criminal cases in state and federal appellate courts.  Before joining the firm, Zach served as the Simon Karas Fellow in the Ohio Attorney General’s Office.  While there, he participated in briefing cases before the U.S. Supreme Court and U.S. Court of Appeals for the Sixth Circuit and briefed and argued cases in state appellate courts, including the Supreme Court of Ohio. The following is a list of representative matters in which Zach has assisted.

Experience Highlights

  • (Tex.) – Authored petition- and merits-stage briefing on behalf of government contractor in case of first impression addressing the proper standard for when government contractors may share the State’s sovereign immunity 
  • (Tex. Cty. Ct.) – Presented argument at informal charge conference in condemnation case resulting in $28.8 million favorable verdict 
  • (Tex.) – Representing real estate developer in suit involving challenge to county commissioner’s ultra vires acts that resulted in the denial of plat applications needed to develop a master-planned community
  • (5th Cir.) – Authored merits briefs on behalf of real estate developer in case involving the proper application of statutes of limitation for various federal and state law claims
  • (2d Cir.) – Drafted amicus brief for business organization in support of respondent in case addressing whether law firms may be compelled to produce documents that clients cannot be compelled to produce 
  • (D.C. Cir.) – Drafted amicus brief for business organization in support of respondent in case involving the application of attorney-client privilege to general counsel communications with the client 
  • (9th Cir.) – Briefed and argued civil rights case asserting First Amendment challenge to California regulations restricting appeals rights of inmates 
  • (Tex. App. – Houston [1st Dist.]) – Briefed and argued child possession case on behalf of divorcee and obtained unanimous favorable decision
  • (D.C. Cir.); (D. Mass.); (FERC) – Prepared pleadings and dispositive motions on behalf of natural gas pipelines in response to challenges to pipeline expansions asserted in various forums
  • (Tex.) – Authored brief successfully opposing petition for review of lower court’s decision in a condemnation case affirming $11.6 million verdict and holding that appraiser expert’s opinion could be supported by other comparable sales even if some of his comparables should not have been admitted
