Amazon Pitches Facial “Rekognition” Law to Feds

On Wednesday, September 25, at a surprise appearance after a product event in Seattle, Amazon CEO Jeff Bezos revealed that the company’s public policy team is drafting proposed regulations for facial recognition technology, with plans to share them with the federal government. The move comes several months after Amazon publicly proposed ethical guidelines around the use of facial recognition technology, in an effort to nudge national legislative efforts on the topic.

Big Brother! China Doubles-Down On Ability to Monitor and Collect Data

On May 28, 2019, China released draft Measures for Data Security Management (“Measures”) that purport to implement data protection requirements by creating individual rights to correct and delete personal information from data storage, mandatory notifications to individuals in the event of a data breach, and a presumption of liability on network operators for breaches caused by third-parties. The Measures include a catch-all provision, however, that would compel the network operator (broadly defined) to provide so-called “important data” to the government upon its request.

DOJ Makes Good on “China Initiative” Promise with New Indictments

As discussed in a post last month, the DOJ recently pledged to target Chinese companies and individuals who threaten the United States through the theft of intellectual property—part of the “China Initiative” announced in November 2018. Making good on its word in short order, the DOJ announced this past Monday that a grand jury in the Western District of Washington had returned charges in a ten-count indictment against Huawei Device Co., Ltd. (“Huawei China”) and Huawei Device USA, Inc. (“Huawei USA”) for alleged theft of trade secrets conspiracy, attempted theft of trade secrets, wire fraud, and obstruction of justice.
