Mario A. Apreotesi Senior Associate, Intellectual Property

Mario’s practice includes all aspects of intellectual property litigation, with a focus on complex patent litigation and post-grant proceedings before the Patent Trial and Appeal Board (PTAB). Mario has represented clients in inter partes reviews (IPRs), district court litigation, and on appeal before the Federal Circuit.

Mario has both initiated and defended IPR proceedings before the PTAB.  His IPR experience includes preparing numerous IPR petitions, preparing patent owner preliminary responses, working with experts to prepare supporting declarations, and counseling clients on many aspects of IPR proceedings. 

Mario’s experience in patent litigation includes case preparation, discovery, expert preparation, claim construction, trial preparation, trial, and appeals before the Federal Circuit. Mario has taken and defended depositions, including key experts, and briefed and argued critical claim construction disputes and summary judgment motions. He has litigated patents in a variety of fields, including electronics, integrated circuits, mobile devices, computer networking and internet technology, medical devices, and computer software.

IPR Experience Highlights

  • (PTAB) – Prepared and filed IPR petition for the world’s largest PC manufacturer involving its laptop products 
  • (PTAB) – Initiated three IPR petitions relating to keyboard functionality on behalf of the world’s largest PC manufacturer; following those filings, the parallel district court case settled favorably 
  • (PTAB) – Initiated IPR petitions regarding server technology on behalf of the world’s largest PC manufacturer; shortly after filing, the parallel district court case settled favorably 
  • (PTAB) – Prepared IPR petitions for a medical device distributor as part of a patent infringement litigation brought by a competitor 
  • (PTAB) – Defended a leading wireless handset maker in several cases relating to navigation technology, including the filing of several IPR petitions 
  • (PTAB) – Prepared two IPR petitions for a global telecommunications provider against patent claims relating to communication standards 

Litigation Experience Highlights

  • (E.D. Tex.) – Obtained jury verdict of noninfringement for leading smartphone maker in patent litigation involving universal remote control technology
  • (D.Del.) — Defended the world’s largest PC manufacturer in patent litigation related to its laptop products, including the filing of an inter partes review petition
  • (Fed. Cir.); (D. Del.) — Defended several major gaming companies in a patent infringement lawsuit related to peer-to-peer network technologies; obtained summary judgment of non-infringement after successful claim construction proceedings; Federal Circuit affirmed on appeal
  • (Fed. Cir.); (D. Or.) — Represented the world’s largest personal computer maker in patent litigation related to its software products; obtained summary judgment invalidating both asserted patents as unpatentable; affirmed on appeal
  • (E.D. Tex.) — Represented the world’s largest personal computer company in district court litigation relating to keyboard functionality; following a favorable claim construction ruling, the case settled favorably
  • (S.D. Fla); (E.D.N.C.) — Represented the world’s largest personal computer company in inter partes review petition and district court litigation regarding server technology; following successful transfer motion and filing of IPR petitions, the case settled favorably
  • (Fed. Cir.); (E.D. Tex.); (N.D. Cal.); (S.D. Cal.) — Defended a leading wireless handset maker in several cases relating to navigation technology; after a favorable claim construction ruling in the district court case, the case settled favorably 
  • (E.D. Tex.) — Defended a global telecommunications provider against patent claims relating to handoffs of a cellular phone from one base station to another
  • (E.D. Tex.) — Defended a global telecommunications provider against patent claims relating to communication standards 
  • (M.D. Fla.) — Represented a radio frequency (RF) electronics firm in patent infringement lawsuits 
  • (N.D. Cal.) — Represented a software development company in patent infringement litigation
