Implementing a Dispute Resolution Framework in Construction Projects
Scott Stiegler, a senior associate in V&E’s International Construction Disputes practice, outlines some important considerations when implementing an efficient and effective dispute resolution framework in your construction contract.
From a commercial perspective, parties may consider having executive level negotiations or a facilitated mediation. For more technical disputes, particularly for mega projects, it is common to have a dispute adjudication or resolution board or perhaps even expert determination. Ultimately, as Scott explains, it is up to the parties to seek the framework that best suits their needs and the needs of the project. By establishing these intermediary steps, the parties can establish a framework to attempt to resolve disputes and potentially avoiding the costs associated with court or arbitration proceedings.
