Biogenic Carbon Sources no Longer Exempt from Greenhouse Gas Permitting Requirements

On July 12, 2013, the D.C. Circuit issued a splintered 2-1 decision in Center for Biological Diversity v. EPA, ruling that EPA may not exempt biogenic sources of CO2 from Title V and PSD permitting requirements under the Clean Air Act (CAA). The case is more notable for what it telescopes about other climate change cases than what it means directly for the rule at issue.

The President’s Pledge to Reduce Methane Emissions: What Does it Mean for the Oil & Gas Industry?

In addition to the GHG emissions that are produced when fossil fuels are combusted, the production of oil and natural gas is a source of greenhouse gas emissions. In particular the flowback—the fluid that returns to the surface after a well is hydraulically fractured and before it is producing oil and gas that brings with it associated gas—can result in the venting of methane directly to the atmosphere if not captured and routed to a gathering line or combustion equipment.

Houston’s Tunnels: A Climate Adaptation

This week, I am writing from V&E’s Houston office rather than my normal desk in D.C. On a very hot afternoon, I navigated my way from the office to my hotel through downtown Houston’s tunnels. It struck me that while I had thought the tunnel system was totally bizarre when I first encountered it five years ago, it was actually a brilliant adaptation to Houston’s hot summers.

President Obama’s "War on Coal": Has Anything Really Changed?

One of the buzz-generating elements of President Obama’s climate change speech on Tuesday was his announcement that he will direct the EPA to create carbon pollution standards for both new and existing power plants. Formalized in a Presidential Memorandum issued on the same day, the President directs the EPA to repropose standards for existing power plants—first proposed in April 2012—by September 30 of this year.

President Obama Announces Climate Action Plan

Yesterday, President Obama unveiled his Climate Action Plan, which aims to both reduce emissions of greenhouse gases (“GHGs”) and adapt to the projected impacts of climate change. The Plan reasserts the commitment that President Obama made under the Copenhagen Agreement to reduce the United States’ GHG emissions to 17% below 2005 levels by 2020.
