Regional Greenhouse Gas Initiative Writes in Support of EPA’s Clean Power Plan and Recommends Additional Emission Reductions

Plaintiffs Argue for Greater Consideration of Climate Change Impacts in NEPA Review

In a case pending before the U.S. District Court for the District of Alaska, a group of subsistence fisherman are challenging the U.S. Army Corps of Engineers’ (“Corps”) decision to issue ConocoPhillips Alaska, Inc. (“ConocoPhillips”) a Clean Water Act (“CWA”) Section 404 permit approving a drilling and transportation project in the National Petroleum Reserve in Alaska.

EPA, DOJ Announce $100 million Penalty for Violations of Clean Air Act Vehicle GHG Standards

United States Environmental Protection Agency (“EPA”) Administrator Gina McCarthy and U.S. Attorney General Eric Holder announced the settlement of a Clean Air Act (“CAA”) enforcement case against Hyundai Motor Co. (“Hyundai”) and Kia Motors Corp. (“Kia”). The parties entered into a Consent Decree that, if approved, will require the automakers to pay a $100 million civil penalty, the largest ever penalty issued under the CAA.

House of Representatives Subcommittee Cites New Study to Highlight Potential Costs of EPA’s Proposed Greenhouse Gas Rule

On October 17, 2014, the Energy and Power Subcommittee for the United States House of Representatives released an announcement that EPA’s Clean Power Plan Proposal could cost more than $366 billion based on a new industry-sponsored study by NERA Economics (“NERA”) on the potential impacts of EPA’s proposal on the affordability and reliability of electricity in the United States.

EPA Releases Clean Power Plan Proposal for Territories and Indian Country

This afternoon, EPA released a supplemental proposal to the Clean Power Plan, setting forth its proposed implementation of the Plan in U.S. Territories and Indian Country. The proposal sets forth specific goals for Puerto Rico, Guam, and the three areas of Indian Country that contain affected electricity generation units (“EGUs”).
