U.S. Supreme Court Issues Long-Awaited Decision on EPA GHG Permitting Authority

Since 2010, EPA rules have applied the Clean Air Act’s pre-construction and operating permit programs to emissions of greenhouse gases (GHG). On June 23, a splintered U.S. Supreme Court invalidated those rules to the extent that they trigger permitting obligations based on GHG emissions (Utility Air Regulatory Group (UARG) v. EPA).

EPA Fast-Tracks Approval of TCEQ’s Regulation of GHGs

On February 18, 2014, the U.S. Environmental Protection Agency (“EPA”) proposed to approve as part of Texas’ State Implementation Plan (“SIP”) the Texas Commission on Environmental Quality’s (“TCEQ”) new Prevention of Significant Deterioration (“PSD”) permit program for greenhouse gases (“GHGs”). EPA’s proposal proceeds in parallel with the Commission’s process for adoption of the program rules, which it proposed on November 8, 2013.
