Globalization of Anti-corruption Enforcement
In recent years, governments across the globe have introduced new legislations and significantly stepped up their anti-corruption enforcement efforts. As a result, both the number of investigations and the severity of the penalties have increased dramatically. With the globalization of these efforts, multinational corporations must remain keenly aware of the prohibitions and requirements of the U.S. Foreign Corrupt Practices Act (FCPA), the UK’s 2010 Bribery Act, and similar anti-corruption laws from signatory countries of the Organization for Economic Cooperation and Development’s (OECD) Convention on Combating Bribery of Foreign Public Officials in International Business Transactions, not to mention international sanctions.

Our global anti-corruption legal team’s leadership in this area comes not only through years of experience representing the world’s most sophisticated global companies, but also because this team includes a former DOJ Deputy Attorney General, a recent former chief of the DOJ criminal division who supervised DOJ’s FCPA criminal enforcement unit, several former DOJ prosecutors, and former in-house counsel, and business leaders.

FCPA and Global Anti-corruption Experience

  • Reviewing and evaluating existing anti-corruption policies and developing adherent compliance programs, policies, and training materials to reflect new legislation and increased expectations of global enforcement authorities
  • Conducting anti-corruption training for corporations, including senior management, accounting professionals, and members of the board of directors
  • Structuring initial commercial investments and negotiating corresponding agreements to minimize regulatory risk
  • Crafting due diligence procedures and conducting due diligence reviews of foreign business partners and third-party representatives, including agents and consultants
  • Conducting internal investigations of potential violations of anti-corruption laws and company compliance policies and, where appropriate, disclosing issues to the DOJ, the SEC, and the SFO
  • Responding to and defending against investigations pursued by enforcement agencies, including the DOJ, SEC, and the SFO
  • Bringing claims arising out of the improper practices of counter-parties and third-party representatives
  • Defending companies against shareholder litigation brought in connection with enforcement settlements
