Appellate
Breadth – Depth – Success In state and federal courts across the United States, V&E appellate lawyers have an enviable track record of success representing appellants and appellees, plaintiffs and defendants, amici, and intervenors in financially and legally high-stakes litigation in a variety of industries. Vinson & Elkins’ appellate practice includes not only handling direct appeals of trial court and intermediate appellate judgments and appellate review of administrative action, but also broad experience with such critical activities as petitioning for writs of mandamus or other emergency relief from trial court action, preserving error at trial, preparing and objecting to jury charges, and preparing and presenting post-verdict motions. V&E appellate lawyers also provide legal and strategic counseling to clients on a range of constitutional, statutory, and regulatory issues outside the context of, or in anticipation of, litigation.
National Presence in Appellate Law V&E appellate lawyers appear everywhere our clients need us to be. We have extensive appellate experience in the Supreme Court of the United States and the United States Courts of Appeals. Our practice is particularly strong before the Fifth, Ninth, Tenth, and D.C. Circuits, where we have handled a wide variety of significant appeals. V&E appellate lawyers also have deep experience in the Supreme Court of Texas, the many intermediate Texas appellate courts, and trial courts throughout the state. V&E’s national presence also extends to other state appellate courts, including significant representations in the Supreme Court of Louisiana and the Supreme Court of Oklahoma, as well as state and federal trial courts throughout the country.
Finding the Right Strategy for the Job V&E appellate lawyers tailor appellate strategies for clients across a broad range of industries and legal issues, in disputes involving general commercial law, business torts, mass torts, personal injury, labor, condemnation, antitrust law, jurisdiction, securities law, environmental law, and tax law, among others. We represent companies and individuals in industries as diverse as health care, energy, broadcast media, transportation, construction and engineering, and insurance.
Vinson & Elkins’ track record of appellate successes includes a host of significant victories. V&E appellate lawyers successfully handle a broad range of matters on both direct and interlocutory appeal. V&E appellate lawyers have been particularly effective in overturning substantial adverse jury verdicts, including verdicts that led to multi-million dollar judgments. Before and during trial in both federal and state courts, V&E’s appellate team has obtained writs of mandamus for clients needing immediate relief from a trial court’s action. We likewise have procured and defeated discretionary review in the Texas Supreme Court and certiorari review in the Supreme Court of the United States.
Talent and Experience to Get the Job Done Vinson & Elkins’ appellate practice leaders are strategic thinkers with decades of experience writing and arguing complex matters in a precise but comprehensible style that has earned credibility with courts at all levels. Junior appellate lawyers at Vinson & Elkins provide invaluable writing assistance and research capability, whether for a legal issue to be briefed in an upcoming appeal or for an evidentiary issue to be argued the next morning in an ongoing trial. Nearly every member of V&E’s appellate group has served as a judicial clerk. Our lawyers include former clerks at the Supreme Court of Texas, various federal district courts and courts of appeals, and the United States Supreme Court.
Heading up our appellate practice group are Marie Yeates and Tom Leatherbury, who between them have handled and presented oral arguments in hundreds of appeals involving a myriad of issues. Resident in our Washington office is John Elwood, former Assistant to the Solicitor General. John has extensive experience in the Supreme Court of the United States, briefing cases at the certiorari stage as well as briefing and arguing cases on the merits. John, Marie, Gwen Samora, and Harry Reasoner each have secured appellate victories in multiple federal circuit courts.
