Biography
A former Texas State District Judge, Judge Kyles has a diverse legal practice ranging from federal and state litigation involving commercial, white collar, products liability, personal injury, and administrative law matters. He has tried approximately 150 jury trials in state and federal court, and also served as mediator/arbitrator and special master in a variety of complex multi-party and class action litigation matters, including labor, commercial, and construction disputes as well as DTPA, products liability, personal injury, and medical malpractice lawsuits. Representative engagements have involved corporations in the oil and gas, financial services, chemical production, transportation, tire manufacturing, pharmaceutical drug distribution, and health care industries.
Judge Kyles’ practice also encompasses transactional matters, including the creation and representation of several managed care entities participating in integrated health care delivery systems, and representations involving economic development initiatives ranging from vendor contracting with governmental entities to the development of tax-exempt bond financed student housing for the benefit of several colleges and universities.

Regional counsel for global pharmaceutical corporation in multi-district diet drug litigation in Texas and Arkansas filed by plaintiffs opting out of related class action litigation

Successfully defended Michigan-based HMO against claims brought by a Texas Department of Insurance Receiver attempting to recover $6,000,000 purportedly owed by the HMO’s wholly-owned Texas subsidiary

Represented a multi-specialty physician network in mediation, arbitration and litigation of numerous lawsuits involving breach of contract, tortious interference, anticipatory breach, and fraud claims against HMOs and other business entities

Respond to federal grand jury subpoenas, advise clients regarding grand jury proceedings and appearances, negotiate joint defense agreements, negotiate with federal law enforcement officials, draft pleadings and discovery, take and defend depositions

Successfully defended the Regional Vice President of one of the largest U.S. hospital corporations against FBI and SEC investigations of the executive’s alleged involvement in the company’s health care fraud scheme, resulting in no prosecution and no parallel civil liability against my client

Successfully defended the Senior Vice President and COO of a publicly traded financial institution during a multi-year federal grand jury investigation of allegations that the COO defrauded and contributed to the failure of the financial institution. There were no criminal prosecutions and no parallel civil liabilities found against my clients
Pro Bono

Negotiated an agreement with the City of Houston for Vinson & Elkins associates to participate in the City’s Municipal Court Attorney Loan Program. Supervised the pro bono program, which entails the firm’s commitment to supply five firm associates to serve as volunteer deputy prosecutors for the City’s municipal courts for a 20-week term. Each volunteer lawyer is assigned to court one day per week, during which they manage case dockets, negotiate cases, argue motions and try municipal court cases. To date, 20 firm associates have served as City of Houston volunteer prosecutors. My supervision of the program has included recruitment, orientation and training, serving as liaison with the City Attorney’s Office, firm administration for the program, and participant evaluations
Transactional Experience View All
- Served as developers’ counsel for six university tax-exempt bond financed privatized multi-family student housing projects. Created single purpose entities to facilitate the not-for profits’ ownership and management of these projects with no recourse to the supported universities
- Served as bond counsel and underwriters’ counsel working with lenders, financial advisers, investment bankers and regulatory agencies in connection with the financings for multi-family student housing projects
- Supervised teams of attorneys in drafting and negotiating bond documents, preliminary offering statements, remarketing agreements, bond purchase agreements, bond resolutions, closing documents, developer’s construction and financing agreements, management agreements, and agreements with not-for-profit owners
