Representative Experience
As Lead Counsel View All
- Won ten out of eleven appeals to the Federal Circuit and was partially successful in the eleventh appeal. The appeals included significant holdings related to inequitable conduct, judicial estoppel, damages, assignor estoppel, and obviousness. One appeal resulted in a favorable reversal, without remand, of an adverse district court judgment of derivation, obviousness and inequitable conduct
- Won at trial in July 2007 for a group of defendants in a patent litigation in the Eastern District of Texas; the patent litigation was instituted by AdvanceMe Inc. on a patent relating to the automatic repayment of loans to merchants out of credit card receipts; we won at trial by establishing invalidity of all asserted claims based on evidence of prior public use of the patented invention; our win in the litigation was affirmed by the Federal Circuit in July 2008
- Successfully represented Langeman Manufacturing in a patent litigation filed against a group of defendants in Madison, Wisconsin; the Langeman patents related to a novel method of trimming linings applied to truck beds; after a total victory on claim construction and a favorable summary judgment of infringement, the case settled favorably to Langeman in September 2008 shortly before trial was due to commence in Madison
Pro Bono Cases
- Was successful in 2004 in a significant pro bono criminal case, by securing a new trial for Jim Tenny in a Federal Habeas Corpus Petition after Tenny had been convicted of murder and sentenced to 65 years in prison; the petition was granted because we established that Tenny's trial counsel had failed to represent him competently at trial in presenting defenses of self-defense and sudden passion; the grant of the habeas corpus petition was affirmed by the Fifth Circuit; we were successful in Jim Tenny’s new trial in Llano, Texas where the jury found him guilty only of aggravated assault with a sentence of five years, which was less than the six and one-half years that he had already served
