Biography
Nicki’s litigation practice focuses on securities class actions, shareholder derivative actions, director and officer liability, intellectual property, and ERISA matters. Her litigation experience includes motion to dismiss and summary judgment hearings, formulation of trial strategy, and assisting in an advisory jury trial in the Western District of Texas and an International Trade Commission Investigation hearing. Prior to joining Vinson & Elkins, Nicki served as law clerk to The Honorable David M. Ebel of the U.S. Court of Appeals for the Tenth Circuit.


Representative Experience
Securities Litigation
  • Assisted in obtaining dismissal of all claims in a derivative lawsuit filed against board of directors of public company in connection with a restatement of earnings resulting from accounting for stock options.
  • Assisted in obtaining favorable settlement of all claims in a derivative lawsuit filed against semiconductor manufacturer in connection with a restatement of earnings resulting from accounting for stock options.
Patent Litigation
  • Assisting in representation of Fortune 50 company before International Trade Commission in Section 337 investigation involving wind turbine clean-energy technology.
  • Assisted in successfully representing inventor of novel method of trimming linings applied to truck beds in patent litigation and obtaining total victory on claim construction, favorable summary judgment of infringement, and favorable settlement.
ERISA Litigation
  • Assisting in representation of telecommunications company against a putative class action ERISA case.
  • Assisted in obtaining dismissal of ERISA stock-drop class action filed against Blockbuster and certain of its officers and directors in connection with Blockbuster's split-off from Viacom, Inc.
Pro Bono
  • Assisting in representing Texas death row inmate in federal habeas petition and appeal to United States Supreme Court.
