Biography
John focuses his practice on commercial litigation in the accounting, securities, and insurance industries. He is admitted in all state and federal courts in Texas, has an active national practice, and routinely appears before the Securities and Exchange Commission and the Texas State Board of Public Accountancy. A significant portion of John’s securities practice includes disputes related to mergers and acquisitions involving public companies. The remainder of John’s practice involves general business litigation, with a focus on real estate disputes, partnership disputes, and matters involving termination of business relationships. He currently serves as the co-practice group leader of the Complex Commercial Litigation Practice and is a member of V&E’s Management Committee.

- Lead counsel for Big Four accounting firm in litigation, SEC investigation, and State Board of Public Accountancy investigation arising out of $80 million embezzlement by CFO of public company
- Lead counsel for Big Four accounting firm in SEC investigation of revenue recognition practices by accounting firm client
- Tried $40 million audit malpractice case to successful jury verdict in favor of Big Four accounting firm

- Represents buyers, sellers, and directors and officers in shareholder class action and derivative litigation arising out of merger transactions
- Recent transactions: management buyout of Exco Corp. (2011); private equity acquisition of Sport Supply, Inc. (2010); acquisition of Odyssey Healthcare by Gentiva, Inc. (2010); private equity acquisition of Entrust, Inc. (2009); private equity acquisition of TXU Corp. (2007); private equity acquisition of United Surgical Partners International, Inc. - Lead counsel for insurance company in coverage litigation surrounding church bus crash in East Texas
- Defended international insurance company in litigation surrounding fraudulently produced nursing home insurance
- Lead counsel in class actions against insurance company allegedly underpaying disability benefits to policyholders and failing to provide timely benefits decisions to workers' compensations claimants
General Business Litigation Matters View All
- Assisted real estate developers in litigation surrounding the sale and purchase of real estate assets and partnership disputes
- Represented majority-in-interest of a real estate partnership in dispute with minority partners and dissolution of the partnership
- Lead counsel for mining equipment manufacturer in injunction proceedings denying temporary injunction and affirming termination of exclusive distribution agent
