Biography
For more than 30 years, Jack's practice has focused on high-stakes commercial litigation, arbitration, and agency proceedings. His wide-ranging experience includes cases in fields such as antitrust, patent infringement, contract, tax, securities regulation, and business torts. Jack has extensive trial experience for both plaintiffs and defendants, having presented or cross-examined dozens of expert witnesses at jury and bench trials and before arbitration panels in cases with hundreds of millions of dollars at stake. He has also handled oral arguments before four federal circuit courts of appeals. Jack has extensive experience in the legal and technical (e.g., economic, financial, and statistical) aspects of complex damage models.

  • For plaintiffs, presented and cross-examined the parties' damages expert witnesses (including a leading financial economist and a Nobel laureate) in a multi-million-dollar breach of contract action against the federal government tried in the U.S. Court of Federal Claims for a major Texas financial institution and investors
  • For defendant, responsible for eight industry and damages experts designated by the parties in a $200 million patent infringement action tried to a jury in federal district court in Texas
  • For defendant, presented and cross-examined the parties' solvency experts in a declaratory judgment trial in the Delaware Court of Chancery
Arbitration/Mediation Proceedings

  • Presented and cross-examined the parties' accounting and statistical expert witnesses in an eight-month private arbitration hearing on the allocation between two manufacturers of $1 billion dollars in product liabilities
  • For plaintiff, presented and cross-examined the parties' financial and statistical expert witnesses in a one-month AAA arbitration hearing on a claim for termination and $50 million in damages for fraud and breach of a wholesale supply contract
  • For plaintiff, handled an international ICC arbitration for an Asian client seeking termination and $100 million in damages for breach of a joint venture agreement with a major United States manufacturer
