Biography
James's principal areas of practice are rate regulation of natural gas pipelines and storage companies by the Federal Energy Regulatory Commission (FERC), including administrative litigation before the FERC; regulatory compliance for pipelines, storage providers, marketers, and importers of natural gas; obtaining necessary authorizations from FERC for energy infrastructure projects; rulemakings at FERC involving the regulation of natural gas transportation and storage; and transactions involving natural gas pipelines and storage facilities as well as midstream assets such as gathering lines, processing facilities, NGL pipelines, and fractionation plants.

Representative Experience
Rate and Tariff Regulation View All
- Led the litigation team in a month-long hearing at FERC representing a major Northeast natural gas pipeline company in a proceeding involving a NGA Section 4 rate increase proposed by a joint owner of some of the pipeline company’s facilities
- Represented, along with other Vinson & Elkins attorneys, a major Northeast natural gas pipeline in a NGA Section 4 proceeding at FERC to raise its rates.
- Represented, along with other Vinson & Elkins attorneys, a major Northeast natural gas pipeline in a NGA Section 4 proceeding at FERC to reduce its rates subsequent to an expansion project.
Transactions/Energy Projects View All
- Represented natural gas producer in the negotiation of natural gas pipeline precedent agreements and transportation agreements for pipeline expansion projects designed to accommodate the producer’s future production in the Southern United States
- Represented natural gas producer in the Mid-Atlantic in negotiation of midstream agreements including natural gas gathering, natural gas processing, condensate gathering, and natural gas sales agreements
- Represented, along with another Vinson & Elkins attorney, natural gas producer in the South West in the negotiation of midstream agreements including NGL transportation and fractionation agreements
Regulatory Compliance and Policy Initiatives View All
- Assisted with regulatory compliance initiatives for major United States natural gas pipelines
- Assisted with drafting and submitting comments, reply comments, a request for rehearing, and an appeal to the D.C. Circuit on behalf of major United States natural gas pipelines and storage facilities relating to FERC rulemaking regarding new capacity release rules for natural gas pipelines, Order No. 712
- Assisted with drafting comments in various other rulemaking proceedings before the FERC on behalf of major United States natural gas pipelines and storage facilities
