Biography
Frank’s practice focuses on business litigation. He represents plaintiffs and defendants in a wide range of disputes, including antitrust, breach of contract, fraud, tortious interference, and other complex litigation. Frank has significant experience litigating commercial disputes in the federal courts, including multiple jury trials. He has counseled clients on antitrust matters involving the agricultural, health care, and transportation industries.

- Part of a team that obtained dismissal of a federal antitrust suit against the City of Dallas arising out of its agreement with airlines and municipalities to resolve the Wright Amendment controversy
- Successfully assisted in the defense of the nation’s largest health care GPO in a $600 million Eastern District of Texas antitrust action alleging exclusive dealing and challenging bundled discount arrangements; GPO client settled before trial with no cash payment
- Argued pending motions to dismiss on behalf of the joint defense group in an MDL antitrust class action pending in federal court in Philadelphia
Business Litigation

- Defended a major retailer in the Facebook beacon privacy litigation, including two nationwide class actions alleging violations of federal privacy laws; litigation included a nationwide class settlement in California federal court
- Defended a major retailer in consumer class actions related to its gift card redemption policies; all cases were dismissed or settled favorably shortly before a ruling on a dispositive motion
- Successfully obtained dismissal of $100 million tortious interference suit against the Dallas mayor
Other Litigation
- Successfully defended a municipal government in a series of civil rights cases resulting from alleged misconduct by narcotics police officers; representation included two jury trials in Dallas federal court
