Biography
Eric is a full-service Clean Air Act practitioner. His twenty-five year career has allowed him to undertake the wide array of legal work generated by state and federal air quality laws, including defense of cases brought to enforce them, prosecution of applications for the permits they require, transaction of emission rights created by them, counseling on and auditing of compliance with them, and changing those laws and the rules that implement them.

His success in these endeavors has earned Eric the recognition of the legal press, as he is listed in The Best Lawyers in America, in Chambers USA: America's Leading Business Lawyers, and in Texas Monthly as a Texas “Super Lawyer”. Chambers USA described Eric as “a highly experienced air emissions lawyer, distinguished in the market by the sizable volume of contested air permitting work he undertakes.” In 2003, Texas Lawyer recognized Eric as one of nine “legal innovators” across all legal disciplines based on his work to create the legal infrastructure for and then execute the first-ever emission trades across the Texas–Mexico border.

  • Contested case permitting for many industrial sectors, including coal-fired power generation, nonferrous smelting, waste disposal, rock quarrying and crushing, and chemical processing
  • Developed legislation authorizing cross-border, cross-pollutant emission trading, as well as the rules to implement the legislation, and then obtained governmental approval of the first trade under those rules
  • Negotiated first-ever multi-party emissions trades with Area Emission Credit Organization in Texas
