Biography
Dan's practice focuses on a combination of general business litigation, energy/regulatory matters, and media litigation. Over the years, Dan has taken a leading role on a number of major matters for our clients. Dan represents defendants and plaintiffs in a wide range of disputes in federal and state courts, including securities, class actions, patent, trademark, product liability, breach of contract, fraud, and tortious interference. Dan’s experience in media litigation includes defending national news publications and networks in defamation cases. Additionally, Dan assists in the representation of regulated companies in contested proceedings before the Public Utility Commission of Texas and the Railroad Commission of Texas.
Dan has also played an active leadership role at Vinson & Elkins since joining the firm. He has served on the Recruiting Committee and currently serves on the firm’s Pro Bono Advisory Committee.

Representative Experience
Media and Entertainment Litigation View All
- Obtained summary judgment in favor of CBS Stations Group of Texas in a defamation action arising out of several broadcasts and an internet report about the care given to three Fort Worth Police Department mounted patrol horses that were boarded at a private facility
- Assisted in obtaining summary judgment in favor of The New York Times, WGBH, and the CBC in a defamation action in Texas arising out of Pulitzer Prize-winning series and companion documentary on worker safety
- Assisted in obtaining summary judgment in favor of CBS Stations Group of Texas and Viacom Inc., in a defamation action in Texas arising out of an investigative report about an Austin neurosurgeon; affirmed on appeal, Neely v. Wilson, 331 S.W. 3d 900 (Tex. App. – Austin 2011, pet. filed)
Commercial and Business Litigation View All
- Represented a private equity company and members of the board of directors of a medical imaging company in an expedited case regarding claims for breach of fiduciary duty, declaratory judgment and injunctive relief; on eve of trial, plaintiffs agreed to a consent judgment dismissing their claims and entering judgment in favor of our clients’ counterclaims for declaratory judgment and injunctive relief
- Member of a team defending a leading global payment services company in a shareholder class action lawsuit; Delaware Chancery Court denied plaintiffs’ request to enjoin company’s $1.5 billion recapitalization
- Obtained $17 million summary judgment on behalf of bank client against borrowers and also defeated attempts by borrowers to bring lender-liability counterclaims
Energy/Regulatory Litigation View All
- Represented Texas’ largest electrical utility in three highly contested proceedings before the Public Utility Commission of Texas (PUC) for applications for certificates of convenience and necessity for proposed Competitive Renewable Energy Zone (CREZ) transmission facilities, estimated at $418 million; PUC approved all three applications
- Assisted in representation of Texas' largest electrical utility in proceedings before the Public Utility Commission of Texas in which the utility was awarded, under current estimates, $1.75 billion of CREZ transmission facilities in Texas
- Assisting in representation of Texas’ largest surface mining company in a contested case before the Railroad Commission of Texas

- Tried 11 jury trials and three bench trials as a full-time visiting prosecutor with the Dallas County District Attorney (May - July 2008)
- Regularly handles jury and bench trials as a visiting prosecutor for the City of Grand Prairie (October 2007 - present)
- Member of V&E’s Pro Bono Advisory Committee and contact attorney for the Dallas Volunteer Attorney Program
