Biography
Avelyn’s principal area of practice is complex patent litigation. Avelyn has experience in all phases of litigation preparation and strategy, Markman hearings, trial preparation, and both jury and bench trials.  She has experience in handling matters in a wide-range of technological fields including the chemical, biomedical device, mechanical, semiconductor, electrical, and computer fields. In addition to her litigation experience, Avelyn has authored numerous infringement, validity, and freedom to operate opinions primarily in the chemical and mechanical fields. She also has been involved in licensing disputes and negotiations and the transfer and licensing of intellectual property assets.

  • Represented Langeman Manufacturing, Ltd. in a patent litigation filed against a group of defendants in Madison, Wisconsin; after a successful claim construction ruling and a favorable summary judgment of infringement, the case settled shortly before trial
  • Represented a major eye care company in a suit brought in the Eastern District of Texas involving patents directed to extended wear contact lenses
  • Represented a Japanese company in a suit involving patents relating to automatic sorting technology
Pro Bono Matters
  • In 2004, secured a new trial for Jim Tenny through a Federal Habeas Corpus Petition after Mr. Tenny had been convicted of murder and sentenced to 65 years in prison; the writ was granted because we established that Mr. Tenny's trial counsel had failed to represent him competently at trial in presenting defenses of self-defense and sudden passion; obtained a unanimous decision from the Fifth Circuit in 2005, affirming the trial court's prior granting of the writ; in March 2006, sat second chair at the retrial of Mr. Tenny by the State of Texas, obtaining an acquittal on the charge of murder and a time-served verdict on the lesser charge of aggravated assault
